2. Eligibility

The BuildAGolfSim Holiday Giveaway 2025 ("Contest") is open ONLY to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry.

RESIDENTS OF ANY OTHER COUNTRY, TERRITORY, OR JURISDICTION ARE NOT ELIGIBLE TO ENTER OR WIN. THIS CONTEST IS STRICTLY LIMITED TO UNITED STATES RESIDENTS. NO EXCEPTIONS WILL BE MADE.

Employees, officers, directors, and agents of BAGS Ventures ("Sponsor"), and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and any other company involved in the design, production, execution, or distribution of the Contest (collectively, "Contest Entities"), and each of their immediate family members (spouse, parents, siblings, and children, regardless of where they reside) and household members (whether or not related), are not eligible to participate or win.

The Contest is subject to all applicable federal, state, and local laws and regulations. Participation constitutes entrant's full and unconditional agreement to these Official Rules and Sponsor's decisions, which are final and binding in all matters related to the Contest.

3. Contest Period

The Contest begins on December 17, 2025, at 12:00:00 a.m. Mountain Standard Time ("MST") and ends on December 31, 2025, at 11:59:59 p.m. MST (the "Contest Period"). Sponsor's computer is the official timekeeping device for this Contest. Entries submitted before or after the Contest Period will not be eligible.

4. How to Enter

To enter the Contest, you must create a free account on buildagolfsim.com during the Contest Period.

Once registered, you can earn entry points ("Points") by completing the following activities on the BuildAGolfSim platform:

• Account Sign-Up: 100 Points (one-time only)
• Submit a Product Review: 50 Points per review
• Save a Build: 25 Points per saved build
• Create a Forum Thread: 30 Points per thread
• Post a Forum Reply: 15 Points per reply
• Share a Build to Community: 75 Points per share

Limit: One (1) account per person. Multiple accounts created by the same individual will result in disqualification of all entries associated with such accounts. Points are tracked automatically within your account dashboard.

Entries must be received during the Contest Period. Any entries that are incomplete, illegible, corrupted, or otherwise not in compliance with these Official Rules will be disqualified. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, misdirected, or undelivered entries, or for any technical or human error that may occur during the processing of entries.

5. Winner Selection and Notification

One (1) potential winner will be selected based on the highest total Points accumulated during the Contest Period. In the event of a tie, the entrant who registered first (based on Sponsor's records) will be declared the winner.

The potential winner will be notified by email within three (3) business days after the end of the Contest Period. Sponsor is not responsible for any change in entrant's email address or other contact information. If a potential winner cannot be contacted within five (5) days after the first notification attempt, or if the potential winner fails to respond within the time specified, or if any prize notification is returned as undeliverable, the potential winner may be disqualified and an alternate winner may be selected.

6. Affidavit of Eligibility and Liability/Publicity Release

As a condition of being awarded the prize, the potential winner may be required to execute and return an Affidavit of Eligibility, a Liability Release, and (where permitted by law) a Publicity Release within seven (7) days of notification. Failure to return such documents within the specified time period, or if the documents are returned as undeliverable, may result in disqualification and selection of an alternate winner.

Grand Prize (1): One (1) Rapsodo MLM2PRO Golf Launch Monitor. Approximate Retail Value ("ARV"): $699.99 USD.

Prize is non-transferable and no substitution or cash equivalent is permitted, except at Sponsor's sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason.

Winner is solely responsible for all federal, state, and local taxes associated with the receipt and/or use of the prize. An IRS Form 1099 may be issued in the name of the winner for the actual value of the prize received.

8. Prize Delivery

THE PRIZE WILL BE SHIPPED ONLY TO A VALID UNITED STATES ADDRESS. NO INTERNATIONAL SHIPPING IS AVAILABLE.

The winner must provide a valid U.S. shipping address within seven (7) days of prize confirmation. Failure to provide a valid U.S. address will result in forfeiture of the prize and selection of an alternate winner.

Sponsor is not responsible for any shipping delays, damage during shipping, or any other issues that may occur during delivery. Prize delivery may take up to four (4) weeks after winner verification.

9. Odds of Winning

The odds of winning depend on the number of eligible entries received during the Contest Period and the total Points accumulated by each entrant.

10. General Conditions

By participating in the Contest, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final and binding. Sponsor reserves the right, in its sole discretion, to disqualify any entrant who:

• Tampers with the entry process or the operation of the Contest;
• Violates these Official Rules;
• Acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person;
• Attempts to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices.

Sponsor reserves the right to cancel, suspend, or modify the Contest if any fraud, virus, bug, or other technical problem corrupts the administration, security, or proper play of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor may select the winner from all eligible entries received prior to the action taken.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS' FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Publicity Rights

Except where prohibited by law, participation in the Contest constitutes the winner's consent to Sponsor's use of the winner's name, likeness, photograph, voice, opinions, biographical information, and state of residence for promotional purposes in any media, worldwide, without further payment or consideration.

12. Release and Limitations of Liability

By participating in the Contest, entrants agree to release and hold harmless Sponsor and the Contest Entities, and each of their respective officers, directors, employees, agents, and representatives (collectively, "Released Parties") from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Participation in the Contest;
• The acceptance, possession, use, or misuse of any prize;
• Any technical failures, including but not limited to: malfunctions of computer hardware or software, telephone lines, satellite transmission, network connections, or other connectivity issues;
• Unauthorized human intervention in any part of the Contest;
• Technical or human error in the administration of the Contest or the processing of entries;
• Any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use of any prize.

LIMITATION OF LIABILITY: IN NO EVENT WILL THE RELEASED PARTIES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE TOTAL LIABILITY OF THE RELEASED PARTIES SHALL NOT EXCEED THE ACTUAL VALUE OF THE PRIZE WON BY THE ENTRANT.

13. Force Majeure

If, for any reason, the Contest is not capable of running as planned due to any cause beyond the reasonable control of Sponsor, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, acts of God, war, terrorism, epidemic, pandemic, natural disaster, or any other causes that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest.

14. Governing Law, Disputes, and Arbitration

This Contest is governed exclusively by the laws of the State of Colorado, United States, without regard to conflict of law principles.

BINDING ARBITRATION:

Except where prohibited by law, as a condition of participating in this Contest, entrant agrees that:

• Any and all disputes, claims, and causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action;
• Any and all disputes, claims, and causes of action shall be resolved exclusively by final and binding arbitration under the rules of the American Arbitration Association, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof;
• Any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event shall entrant be entitled to receive attorneys' fees;
• Under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses.

CLASS ACTION WAIVER:

TO THE FULLEST EXTENT PERMITTED BY LAW, ENTRANT AGREES THAT ANY ARBITRATION OR LEGAL PROCEEDING SHALL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

LIMITATION ON TIME TO FILE:

Any claim or cause of action arising out of or related to this Contest must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

15. Privacy

Information collected from entrants is subject to Sponsor's Privacy Policy, which can be found at buildagolfsim.com/privacy. By entering the Contest, entrants consent to the collection, use, and disclosure of their personal information as described in the Privacy Policy.

16. Social Media Disclaimer

This Contest is in no way sponsored, endorsed, administered by, or associated with any social media platform, including but not limited to Facebook, Instagram, Twitter, or TikTok. Entrants understand that they are providing information to Sponsor and not to any social media platform.

17. Severability

If any provision of these Official Rules is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Official Rules constitute the entire agreement between entrants and Sponsor with respect to the Contest and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
